Terms of Service

We are an online event and tournament organization that brings players together using internet-based communications platforms that feature voice+video and live chat. Due to past abuses, we have been forced to operate under a zero-tolerance policy and thus reserve the right to ban any member without warning for violating any of these rules, which are are strictly enforced at all times:

-No yelling, screaming, obnoxious or offensive language. Keep the volume loud enough for “YOU” to hear.

-No fighting or “virtual” horseplay or rough housing.

-Please ask other players before joining their games, where applicable.

-If you have been drinking alcohol and/or you behave in a disorderly, disruptive or inebriated manner, you will not be allowed to participate and will be asked to leave the game immediately (without a refund, if applicable).

-No adult content or pornography of any kind should be posted or streamed.

-No cheating, hacking, or stealing. Any attempt to steal any other player’s information will result in a permanent ban.

-Any attempt to game or manipulate our software, system or staff to gain free account time or any other products or services we offer will result in a permanent ban.

-For in-person events: you may bring your own storage/memory device and we will allow you to save your game.

-Everyone under the age of 17 must have a parent sign for permission to play M or T rated games. Children under 12 years old must be supervised by an adult at all times. NO EXCEPTIONS.

–We reserve the right to refuse service to anyone. That said, please treat everyone during the event with respect and the same will be done for you.

Cyberbullying is bullying that takes place over digital devices like cell phones, computers, tablets, and consoles. Cyberbullying can occur through SMS, Text, and apps, or online in social media, forums, or gaming where people can view, participate in, or share content. Cyberbullying includes sending, posting, or sharing negative, harmful, false, or mean content about someone else. It can include sharing personal or private information about someone else causing embarrassment or humiliation. Some cyberbullying crosses the line into unlawful or criminal behavior.

The most common places where cyberbullying occurs are:

• Social Media, such as Facebook, Instagram, Snapchat, and Tik Tok
• Text messaging and messaging apps on mobile or tablet devices
• Instant messaging, direct messaging, and online chatting over the internet
• Online forums, chat rooms, and message boards, such as Reddit
• Email
• Online gaming communities

Cyberbullying also includes photos, messages, or pages that don’t get taken down, even after the person has been asked to do so. In other words, it’s anything that gets posted online and is meant to hurt, harass, or upset someone else.

Intimidation or mean comments that focus on things like a person’s gender, religion, sexual orientation, race, or physical differences count as discrimination, which is against the law in many states. That means the police could get involved, and bullies may face serious penalties.

If the conduct occurs during a Isthmian Gaming public or private event, and causes or threatens to cause a substantial disruption at said event, or interferes with the rights of gamers to feel safe and secure, Isthmian Gaming reserves the right to impose consequences, including but not limited to, removal of the offender without warning. The Isthmian Gaming Administration Team may also report the Cyber Bullying or Harassment to the police.

Action Steps to Respond to Cyber Bullying or Harassment:

· Save the evidence. Print online harassment.
· Identify the Cyber Bully.
· Clearly tell the Cyber Bully to stop.
· File a complaint of Cyberbullying with Isthmian Gaming

Any gamer who believes that he/she/they is/are being subjected to bullying/cyberbullying behavior, as well as any other person who has knowledge of or witnesses any possible occurrence of bullying/cyberbullying, shall report the bullying to any staff member of Isthmian Gaming or the Event Coordinator. The staff member/Event Coordinator to whom the report is made (or the staff member/Coordinator who witnesses bullying behavior) shall investigate the complaint and take appropriate action to include, as necessary, referral to the next level of supervisory authority and/or other official designated by Isthmian Gaming to investigate allegations of bullying. Investigation of allegations of bullying shall follow the procedures utilized for complaints of harassment within the law. Allegations of bullying shall be promptly investigated and will be treated as confidential and private to the extent possible within legal constraints.

Prevention and Intervention

Isthmian Gaming staff at all levels are responsible for taking corrective action to prevent bullying behavior of which they have been made aware at Isthmian Gaming events or activities and/or reporting such behavior to their immediate supervisor. Further, staff training is provided to raise awareness of the problem of bullying and to facilitate staff identification of and response to such bullying behavior among gamers.

Prevention and intervention techniques within Isthmian Gaming to prevent bullying behavior and to support and protect victims shall include strategies and activities as determined by administration. Individual intervention will be provided by appropriate staff members to bullies, victims and their parents to help ensure that the bullying stops.

The Isthmian Gaming Administration Team prohibits any retaliatory behavior directed against complainants, victims, witnesses, and/or any other individuals who participate in the investigation of allegations of bullying. Follow-up inquiries and/or appropriate monitoring of the alleged bully and victim shall be made to ensure that bullying behavior has not resumed and that all those involved in the investigation of allegations of bullying have not suffered retaliation.

This agreement sets the standard terms for customer rental imposed by Isthmian Gaming. By reserving and renting this venue, the purchasing customer (renter) agrees to these stipulations and rules of conduct:

• As a renter, I am only receiving a license for the agreed upon venue space which may be limited to the rental time that has been reserved and paid for. Isthmian Gaming may restrict my access to the premises for any reason immediately before and after my rental time has started and expired.
• I understand that while every effort is made to avoid schedule conflicts, problems may occasionally arise, and that Isthmian Gaming reserves the right to move my appointment time and/or day as needed. In such cases, I will be notified at the earliest possible opportunity.
• I must not act in a manner that, in Isthmian Gaming‘s sole discretion, does or is likely to adversely affect the peaceful operation of the premises.
• I will not use the premises for illegal purposes or in any manner that could tarnish the reputation of Isthmian Gaming or their premises.
• I will not tamper with, borrow, or remove any property kept on the premises.
• I will not cause or permit any hazardous substance to be used, stored, generated, released or disposed of on or in the premises.
• I understand that I must maintain my rental area and the common areas of the premises in a neat, clean and in a sanitary condition.
• I will be held solely responsible for the agreed upon rental area, including any common areas.
• I will be held accountable for any injury, property or other damages sustained during the duration of the rental and occupancy on the premises.
• I will be held liable for any guest, invitee, or visitor actions on the premises.
• Any signs, symbols, or other objects displayed on the premises must be approved by Isthmian Gaming, installed in such a manner so that they can be removed without leaving any hole(s) and or damage to the premises, and must be removed immediately following the duration of the reservation. 
• I will not sell or attempt to sell any products, merchandise, concessions (snacks, drinks, candy) or anything else on or around the Isthmian Gaming premises. 

Neither Isthmian Gaming, nor its respective agents shall be liable for, and Renter agrees to defend and hold Isthmian Gaming and their respective agents harmless from, any claim, action and/or judgment for damages to property or injury to persons suffered or alleged to be suffered on the Premises by any person, firm or corporation.

Renter shall indemnify, defend and hold Isthmian Gaming harmless from and against all loss, cost and expense, including attorney’s fees, arising from any act, omissions of negligence of Licensee or its officers, contractors, licensees, agents, servants, employees, guests, invitees or visitors in or about the Property. The foregoing provisions shall not be construed to make Renter responsible for loss, damage, liability or expense resulting from injuries to third parties caused solely by the gross negligence or intentional misconduct of Isthmian Gaming or their officers, contractors, licensees, agents, employees of other tenant of the Property.

To the fullest extent permitted by applicable law (i) Renter specifically and expressly waives any immunity it may be granted it under the New Jersey Insurance Code and any similar federal, state or local laws, ordinances or regulations, and (ii) Renter’s indemnity obligations under this lease shall not be limited by any limitation on the amount or type of damages, compensation or benefits payable to or for any third party under any applicable Worker Compensation Acts, Disability Benefit Acts or other employee benefit acts, ordinances or regulations. The parties have specifically negotiated and mutually agreed upon the provisions of this paragraph.

*This Agreement may reference sections from the Isthmian Gaming website Terms of Service document. If there is a discrepancy between the two documents, the more restrictive term(s) shall prevail.
All other terms of service and rules as stated in the sections above this rental agreement apply.
